What is an F‑1 Student Visa?

The F‑1 nonimmigrant visa is for international students who come to the United States to pursue a full‑time academic degree at a SEVP‑certified school. F‑1 students are admitted for “Duration of Status” (D/S), meaning they may remain in the U.S. as long as they maintain their lawful student status, without needing to file an extension with USCIS.

Basic Requirements for Maintaining F‑1 Status

F‑1 visa holders must continuously fulfill the following obligations to maintain valid status:

  • Maintain full‑time enrollment: at least 12 credits per semester for undergraduates, and at least 8 credits for graduate students (or as required by the school);

  • Actively pursue studies: attend classes, take exams, complete coursework as required, and make progress toward the degree;

  • Engage only in authorized employment: off‑campus work related to the major is allowed only after one academic year and with authorization from the DSO and USCIS. Unauthorized work is a serious violation;

  • Keep the I‑20 valid: ensure the Form I‑20 is current and unexpired;

  • Update address and passport information promptly;

  • Consult the DSO before any change of plans, such as changing majors, transferring schools, taking a leave of absence, traveling abroad, or requesting an extension of program.

Failure to maintain status may result in loss of OPT eligibility, difficulty in future visa applications, or even removal proceedings.

Special Reminder Before Applying for Adjustment of Status

F‑1 is a single‑intent nonimmigrant visa, meaning the holder must have intended to return home after completing studies at the time of entry. If an F‑1 student files Form I‑485 (Application to Register Permanent Residence or Adjust Status) within 90 days of the most recent entry, USCIS may presume that the applicant misrepresented their intent at entry (willful misrepresentation).
Recommendation: Wait at least 90 days after your last entry into the U.S. before getting married and filing I‑485. Each re‑entry resets the 90‑day clock. This rule does not affect your daily student status maintenance, but it is critical to consider before taking any step toward a green card application.
