H-1B $100,000 Fee Proposal — Take One Minute to Submit a Comment

There is a proposal requiring all newly selected H-1B petitions after August 24 to pay a $100,000 fee. There is a 30-day public comment period.


Everyone in the U.S. can take one minute to submit a comment. If implemented, this would be a devastating blow to all foreign workers working in the United States.


Moreover, even if this proposal ultimately does not take effect, it could still significantly discourage companies from hiring foreign workers. Companies are afraid of the hassle, and the uncertainty surrounding these policies may ultimately lead them to choose not to hire foreign workers.

Regarding this proposal, many of the comments currently being submitted by Americans argue that foreign workers are taking job opportunities away from American workers. They believe that if companies have to pay $100,000, they will stop hiring foreign workers, and those job opportunities will then go to Americans.


When we submit comments, we are not trying to portray H-1B foreign workers as victims. Instead, we should frame it this way:


If the true goal of this policy is to protect American workers, then the $103,265 fee could very well have the opposite effect.


This $100,000 fee will not truly protect jobs for American workers. On the contrary, it could result in fewer job opportunities for American workers.


The disappearance of one H-1B position does not necessarily mean that one American worker gets that job. Instead, an entire team, project, or even future hiring could be moved overseas, potentially resulting in significant increases in outsourcing. This could mean fewer job opportunities in the United States.


Moreover, this $100,000 fee is unreasonable, and the money should not be redirected to other government agencies. For a rule with such a significant impact on the economy, a 30-day comment period should not be sufficient.
