⏰ Bringing Your Child Along for I-751? Pay Attention to This 90-Day Rule
In marriage-based family immigration, when a parent files Form I-751—what many people call “removing the conditions” from a two-year conditional green card to obtain a regular 10-year green card—can the child be included in the same application?
The answer depends on when the child obtained conditional permanent resident status.
If the child obtained conditional permanent resident (CPR) status on the same day as the parent, or within 90 days after the parent obtained CPR status, the child can generally be included in the parent’s I-751 petition and does not need to file a separate I-751.

📌 How does this work?
In Part 5 of Form I-751, provide information about the child, including:
👉 Name
👉 Date of birth
👉 A-Number
👉 Current address
👉 Whether the child is applying with you

Then submit the child’s information together with the parent’s I-751 petition. The current I-751 form specifically asks whether each listed child is applying together with the parent.
⚠️ When does the child need to file a separate I-751?
There are several situations, including:
1️⃣ The child obtained conditional resident status more than 90 days after the parent.
In that situation, the child generally needs to file a separate I-751.
2️⃣ The conditional resident parent died before filing the I-751.

USCIS also identifies this as a circumstance in which the child may need to file separately.
USCIS also recognizes other circumstances that prevent the child from being included in the parent’s I-751 as potential reasons for separate filing.
📄 What if the child files separately?
If the child needs to file a separate I-751, the circumstances for the separate filing should be properly explained and supported with the appropriate evidence.

📌 So before preparing the I-751, check the date the child obtained conditional resident status and compare it with the parent’s CPR start date.
That 90-day difference can determine whether the child can be included in the parent’s I-751 or needs a separate petition.
