šŸ“’ What Happens After an H-1B Is Withdrawn or Revoked? ā“

Many people ask:

ā€œAfter my H-1B is withdrawn or revoked, will I receive a notice from USCIS? And what will my Case Status show when I check it using the receipt number?ā€


Actually, the follow-up notices and Case StatusĀ can be different depending on whether the H-1B had already been approved or was still pending when the employer requested the withdrawal.


Today, Attorney Xiaozeng will walk through real-world casesĀ involving two different situations: an already-approved H-1BĀ and an H-1B that was still pendingĀ when the employer requested the withdrawal.


1ļøāƒ£ H-1B was already approved, and the employer requests withdrawal after the employee leaves

In this situation, the notice issued by USCIS is typically titled:

ā€œRevocation of Nonimmigrant Petition: Automatic Revocationā€(See Figure 2)

Let’s first look at the timeline of this case (Figures 2 & 3):

šŸ“… May 27, 2026:Ā USCIS received the employer’s withdrawal request.šŸ“… June 2, 2026:Ā USCIS mailed the revocation confirmation notice.


It took less than one week, which is very fast.


However, this case was filed with premium processing, which may explain the relatively quick processing time.


Why do we say that?


Let’s look at another case in Figures 4 and 5. Again, the H-1B had already been approved, and the employer subsequently requested withdrawal:


šŸ“… January 5, 2026:Ā USCIS received the withdrawal request.šŸ“… May 5, 2026:Ā USCIS finally mailed the revocation confirmation notice.

That’s a full four monthsĀ between the two dates.

But there is one very important detail:

šŸ‘‰ Even though the revocation confirmation notice was not mailed until May, USCIS confirmed that the Automatic Revocation effective date was January 5—the date USCIS received the withdrawal request, notĀ the date the confirmation notice was mailed.


Also, Case Tracker typically does not show exactly when USCIS received the withdrawal request.


You generally need to look at the official USCIS noticeĀ to confirm that date.


2ļøāƒ£ H-1B was still pending, and the employer requests withdrawal

In this situation, the notice is different from the first scenario.


As shown in Figure 6, the notice is simply titled:

ā€œWithdrawalā€

USCIS will formally confirm that the H-1B petition has been withdrawn.

However, this notice may not necessarily state the exact date USCIS received the withdrawal request.


The Case Status timeline can be referenced in Figure 7.

ā€¼ļø So, in simple terms:

H-1B already approved → employer withdraws it → Automatic Revocation

H-1B still pending → employer withdraws it → Withdrawal


šŸ“Œ The key is to first determine whether the H-1B had already been approved when the employer requested the withdrawal.
